1. About these terms

These terms govern your use of bluelotussupply.com (the “Site”) and any purchase from Blue Lotus Supply, 2903 W Clybourn Street, Milwaukee, WI 53208 (“we”, “us”). By using the Site or placing an order, you agree to them. If you do not agree, please do not use the Site.

2. Business customers only

We sell to businesses. By submitting an inquiry or order you confirm that you are at least 18 years old, that you are buying on behalf of a business, and that you are authorized to do so.

3. Products

We supply dried blue lotus flower (Nymphaea caerulea) as a botanical product. Descriptions, specifications and photos on the Site are for general information. Natural products vary from lot to lot, and photos are representative, not a guarantee of appearance. The specification and certificate that accompany your lot apply to that lot.

4. Quotes and orders

Prices on the Site are not offers. We provide pricing by written quote, and a quote stays valid for the period it states. An order is accepted only when we confirm it in writing. We may decline or limit an order, for example if we cannot verify the buyer or if the sale would breach a law.

5. Pricing and payment

Payment terms are agreed with each account and set out in your quote or invoice. New accounts are normally prepaid. Prices exclude freight and any applicable taxes unless stated. We may charge interest or suspend supply on overdue amounts, where the law allows.

6. Shipping and delivery

We ship within the United States unless we agree otherwise in writing. Carrier, cost and estimated delivery time are stated in your quote. Delivery dates are estimates. Risk of loss passes to you when the carrier takes possession of the goods, unless your quote states otherwise.

7. Inspection, claims and returns

Please inspect each delivery on arrival and tell us about damage, shortages or a lot that does not match its specification within the period stated in your quote or invoice. Return, replacement and refund terms for an order are those stated in your written quote. Opened or used product cannot be returned unless it does not match its specification.

8. Your compliance responsibilities

You are responsible for making sure that you may lawfully buy, import, resell, label and market our products where you operate. Laws on blue lotus differ by state and country. For example, Louisiana prohibits Nymphaea caerulea for human consumption. You agree not to make health or medical claims about our products and to follow all laws and marketplace rules that apply to you.

9. Intellectual property

The Site’s text, design, logos, photos and video belong to us or our licensors. You may not copy or reuse them without our written permission, except to share a link to a page.

10. Acceptable use

You agree not to misuse the Site, attempt to disrupt it or access it without permission, send spam or false inquiries, or use it for any unlawful purpose.

11. Disclaimer of warranties

Except as stated in your written quote or required by law, the Site and our products are provided “as is” and without warranties of any kind, whether express or implied, including implied warranties of merchantability and fitness for a particular purpose. See also our Disclaimer.

12. Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for lost profits, arising from your use of the Site or our products. Our total liability for any claim relating to an order is limited to the amount you paid for the products that gave rise to the claim.

13. Indemnity

You agree to defend and indemnify us against claims and costs arising from your resale, labeling or marketing of our products, or from your breach of these terms or of any law.

14. Governing law

These terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Milwaukee County, Wisconsin, and you consent to their jurisdiction.

15. Changes

We may update these terms. The version on the Site when you place an order applies to that order.
